DAP chairperson Karpal Singh had erred in law by citing a case that was unrelated to Islam and using it to criticise the Perak Sultan for ‘interfering’ with the transfer of Perak Religious Department director Jamry Sury.
MIC Youth chief S Vigneswaran said Karpal had cited Federal Territory Education Director and Others vs Loot Ting Yee (1982) which had nothing to do with Islamic affairs and was thus unrelated to Jamry’s case.
“How can Karpal, a distinguished lawyer of senior standing give example of an Education Department staff in a secular dispute with the case of Jamry which is directly within the scope of the religious department under the Sultan,” said Vigneswaran in a statement today.
Vigneswaran stressed that any matters pertaining to Islamic affairs, Islamic bodies or agencies, including the appointment and transfers of officers or staff involved in such bodies is the prerogative of the sultan.
He claimed that Karpal had infringed the rights of the monarch as enshrined in Article 3 (2) of Part I of the Federal Constitution which reads:
“In every State other than States not having a Ruler the position of the Ruler as the Head of the religion of Islam in his State in the manner and to the extent acknowledged and declared by the Constitution, all rights, privileges, prerogatives and powers enjoyed by him as Head of that religion, are unaffected and unimpaired…”
Cheap publicity
Karpal had been the lone voice criticising the Perak Sultan for ordering Perak Menteri Besar Mohd Nizar Jamaluddin to reinstate Jamry after an initial transfer order.
A veteran lawyer and Bukit Gelugor parliamentarian, Karpal on Monday said that the matter was purely a matter of the executive exercising their right over civil servants and the royalty should not have interfered.
Following this, numerous police reports had been lodged against Karpal for allegedly breaching sedition laws and insulting the sultan.
Vigneswaran said Karpal’s statement was a move to create cheap publicity and challenged Pakatan Rakyat coalition to state their stand on the matter.

Very sharp Boss!
You a lawyer eh?
MIC is in quicksand, why not get yr young chaps to give them a hand, if the youth MIC walks out, bye bye to MIC!
Tq for your comment.
I am a law graduate who finished chambering with Pushpalingam, Kasmani and Partners but after the the chambering decided to be in active politics.
We the MIC youth is not deserting MIC and i dont know what made you think that we would. But your concern is the concern of a lot of people outside there who feels that the youth should be given a bigger role to get the younger indians to be brought into the MIC fold or into the party.
Like life every entity goes through various stage of test and for the MIC it too is having its part by loosing almost 2/3 of its seats.
But my friend to say quick sand i dont agree. One shouild realise that the people voted for the opposition or rather in some states the ruling now is not because they have provided good service or service at all but rather because they were unhappy with certain issues that were not given due attention by the BN gorverment on time.
Your prompt response appreciated Sir.
People have outvoted MIC because the reps were like gods. People have voted in opposition leaders who have not done anything for them to see if given a chance, will they serve better than MIC reps or acts like gods again. Whether its MIC or the opposition, we, the civilians, are screwed.
Malaysia is no different from the rest of the world. The indians rebelled against the ridiculous culture that was growing among MIC leaders, the culture of acting God.
Past has passed. Indiands are hoping the young generation will be more united and lead better. My opinion sir, press on unity, sincerrity and humulity.
You fellas are not paid for your hard work but it was your choice to be in it. But the leaders acted god and screwed up even the sincere ones.
Unite the people dude.
God Bless you.
